TERMS AND CONDITIONS OF USE AND CONTRACT

Acceptance of Terms and Conditions
By using the services and content provided by NeoRejuvenation LLC, you confirm that you are at least 18 years of age and that you have read, understood and agreed to these Terms of Use and Contract. If you do not agree, you must not use the services and content provided by NeoRejuvenation LLC.
You are contracting the service with NEOREJUVENATION LLC, hereinafter referred to as THE PROVIDER. By using any part of the service, completing the registration/reservation process and/or payment for the service offered at www.neorejuvenation.com, www.neorejuvenation2.com, www.antoniomoll.com, www.facialneorejuvena.com and all associated subdomains (.en, .uk, .eu, .fr, .de, .pt, .br, .it, .us, .mx, .ar, .cl, .co, .pe) and www.neorejuvena.com, www.neorejuvena.info, www.neorejuvena.org, www.neorejuvena.net, www.neorejuvena.me, and www.neorejuvena.tv, you expressly accept and are subject to all the terms and conditions specified in these Terms of Use and Contracting.

Provision of the Service

NeoRejuvenation LLC is responsible for technical services, including server management, support and access to the training platform. Antonio Moll has assigned the non-exclusive rights to exploit his work to Taking Back My Power Limited, who manages all matters relating to copyright, billing and collection.

Exclusion of Author’s Liability

Antonio Moll, in his capacity as author of the training content, is expressly protected by the laws of the European Union and applicable international law. All rights in his work are registered and created in the European Union, and the management of those rights is delegated to Taking Back My Power Limited, based in Cyprus.

Any claim or legal action relating to copyright, licensing or invoicing will be handled exclusively in the courts of Cyprus, under European Union law, which provides additional protections for EU citizens.

Antonio Moll is expressly disclaimed from any personal liability outside the jurisdiction of Cyprus. Any attempt to prosecute him in other territories, such as the United States, will violate the provisions of the Brussels I Recast Regulations and the Lugano Convention, which protect EU citizens from litigation in non-European jurisdictions.

Furthermore, Antonio Moll shall not be liable for any claims arising from actions or decisions taken by the user based on the training content, except in cases of proven intentional misconduct. This agreement explicitly excludes Antonio Moll’s personal liability in any dispute relating to the technical services provided by NeoRejuvenation LLC or the rights managed by Taking Back My Power Limited.

Jurisdiction and Dispute Resolution

1. Technical Services and Support
   All disputes, claims or controversies relating to the provision of technical services and support provided by NeoRejuvenation LLC shall be resolved exclusively in the courts of the State of Florida, United States. The parties irrevocably agree to submit to this jurisdiction.
2. Copyright, Licensing, Billing or Collections
   Any claim relating to copyright, licensing, billing or collection will first be handled through a mediation or arbitration process in Cyprus, in accordance with European Union law, before resorting to the courts. Any attempt to take legal action against Antonio Moll outside the jurisdiction of Cyprus will be considered a breach of the applicable international legal framework.

Waiver of Jury Trial

You and NeoRejuvenation LLC agree that any dispute, claim or controversy relating to these terms or the use of products and services will be resolved exclusively by a judge in Florida, expressly waiving the right to a jury trial. This waiver is fair and necessary to ensure objectivity and expeditious dispute resolution. The parties understand the consequences of this waiver and voluntarily accept it.

In the event that any provision of this jury waiver is deemed unenforceable under Florida law, such provision shall be severed from the agreement without invalidating the remaining terms and conditions.

Applicable Law

For all claims relating to the technical provision of services offered by NeoRejuvenation LLC, the laws of the State of Florida shall apply. However, all claims related to content, copyright, billing or any aspect related to Antonio Moll’s work will be handled exclusively by Taking Back My Power Limited under the laws of Cyprus and the European Union. Antonio Moll will not be personally involved in any legal action in the United States.

Pricing and Billing

Taking Back My Power Limited will be responsible for issuing electronic invoices and handling payments via the methods set out on the website(s).

Prices for our services are expressed in different currencies, including Euro, Dollar, Pound Sterling, Mexican Peso, Argentine Peso, Colombian Peso, Chilean Peso, Peruvian Sol and Brazilian Real, as selected by the user at www.neorejuvenation.com, and/or its associated subdomains or at www.antoniomoll.com. For specific subdomains (e.g. https://ar. neorejuvenation.com – ARS Currency), the price will be expressed in the currency indicated on the website and payment will be processed in that currency.

The price of each product or service will be the price stipulated at the time of purchase, unless there is a manifest error. Prices may be changed at any time, but changes will not affect previously confirmed orders. Taking Back My Power Limited also reserves the right to modify or cancel applicable discounts.

By accepting these terms, you agree to receive proof of payment in electronic format at the email address provided at the time of payment.

Bank Fees and Currency Conversions

In some cases, your bank or card issuer may apply additional fees or taxes when processing your payment, including currency conversion. These additional fees are not the responsibility of Taking Back My Power Limited or NeoRejuvenation LLC. If your bank applies additional fees, you should contact them directly to resolve any discrepancies. Taking Back My Power Limited will not refund or offset any additional amounts charged by your bank or card issuer.

It is the responsibility of the user to confirm any additional charges related to currency conversion or bank fees. Taking Back My Power Limited complies with Cyprus and EU legislation regarding fee transparency, and the user agrees that the issuing banks are responsible for any costs not explicitly mentioned by NeoRejuvenation LLC or Taking Back My Power Limited.

Payment Disputes and Fraud

In the event of a payment dispute, the user agrees that Taking Back My Power Limited has the right to take legal action against fraudulent disputes. By initiating a dispute without legitimate cause, the user will be responsible for any costs incurred, including legal fees. Taking Back My Power Limited will follow industry best practices and payment platform recommended procedures for managing and resolving disputes, providing all necessary documentation to defend the legitimacy of the payment processed.

Content: Training Modules / Languages and Support

The training modules mentioned at www.neorejuvenation.com and all associated subdomains, www.neorejuvenation2.com, www.antoniomoll.com, www.facialneorejuvena.com, www.neorejuvena.com, www.neorejuvena.it, www.neorejuvena.org , www.neorejuvena.net , www.neorejuvena.me, www.neorejuvena.tv , include video tutorials . These may be broadcast live and/or recorded, with no obligation on the part of the Provider or Taking Back My Power Limited to make a minimum number of live broadcasts . You expressly agree that video tutorials may be pre-recorded, without the need for a live broadcast. The Provider reserves the right to decide the most appropriate mode of educational broadcast.

You expressly agree that the video tutorials may show the actual image of the trainer/trainer or an avatar or virtual representation, as well as diagrams, drawings or notes/text. The Provider reserves this right as it deems appropriate for educational and/or operational dissemination.

Each of the seven (7) main video tutorials shall be longer than forty (40) minutes.

The voice-over (voice) of the video tutorials will be in Spanish. If you have contracted the service in another language (Italian, Portuguese, English, French, German), the video will have subtitles and/or audio dubbed into the corresponding language to facilitate understanding. In the case of Portuguese, the training has been dubbed only in the first three modules, and the rest is subtitled. This information is clearly specified on the Portuguese website.

In addition to the video tutorials, each module will include a written tutorial (in PDF format), so the training consists of 7 (seven) written modules totalling more than 28,000 words. These tutorials are fully translated into the languages offered on the website. In other words, if you have booked the training in Italian, you will see the tutorials written in Italian. The same applies to other available languages.

Each of the seven modules will be published on the dates and at the times indicated on the training platform(www.neorejuvena.com, www.neorejuvena.it, www.neorejuvena.org, www.neorejuvena.net, www.neorejuvena.me, www.neorejuvena.tv). The Provider reserves the right to unlock or publish all modules from the beginning of the training or gradually (one module per week until all seven modules are completed).

The original language of the tutorials is English, as are the subtitles. Although a reasonable effort is made to ensure the quality of translation and transcription, there may be typos or inaccuracies in languages other than English. You expressly agree that such inaccuracies do not entitle you to a refund.

Support is strictly limited to resolving technical issues related to accessing the modules, billing, or doubts not resolved in the video tutorials or PDF documents. Queries must be directly related to NeoRejuvenation content and will be handled by Taking Back My Power Limited or NeoRejuvenation LLC, as appropriate.

The Provider and Taking Back My Power Limited reserve the right not to respond to queries relating to issues already covered in the training materials or which are unrelated to the content of NeoRejuvenation . In particular, questions relating to medical diagnoses, cosmetic formulations, technologies, medical or aesthetic treatments, or personal or professional advice will not be answered.

You expressly accept that the payment made only grants you the right to access the training platform to view the training content. It does not include consulting services or additional advice. The support is intended exclusively to resolve technical questions and objective doubts about the training content that have not been addressed in the materials.

In the event that you make an eligible query, it may take up to six (6) weeks for the Provider or Taking Back My Power Limited to respond. You agree that this timeframe may be extended in the event that the Provider or trainer faces health issues or any other circumstances that prevent them from responding in a timely manner.

Refund Policy

In accordance with Cyprus legislation and Directive 2011/83/EU on consumer rights, the following provisions shall apply to digital products and content offered by Taking Back My Power Limited, the billing manager for NeoRejuvenation LLC.

Waiver of Right of Withdrawal

By accessing our digital content, you expressly acknowledge and agree that you are waiving your right of withdrawal, as set out in Directive 2011/83/EU, and that no refunds will be provided once access to the content has been granted. This waiver is valid from the moment the digital content is made available to you via the educational platform, through the sending of an email confirming your access.

No Refunds are offered for Digital Content.

Digital products and content cannot be returned like physical goods, and our policy is designed to comply with Cyprus and European Union legislation, protecting both consumers and our company. Once access to digital content is granted, the sale is considered final and NON-REFUNDABLE.

Exceptions to the Non-Refund Policy

1. Refund Request Prior to Issuance of License to Use: If you request a refund before we have granted you access to the digital content, your request will be considered, and the refund will proceed accordingly.
2. Double Payments: In the event that you have paid twice for the same product or service, we will issue a refund for the duplicate payment.

Indemnification

You agree to indemnify and hold NeoRejuvenation LLC, Taking Back My Power Limited, and Antonio Moll harmless from any claim, demand, or damage (including legal fees) arising out of your use of the website, your breach of these terms, or your violation of any rights of any third party, provided that such claims do not arise from the gross negligence or proven willful misconduct of NeoRejuvenation LLC, Taking Back My Power Limited, or Antonio Moll .

In the case of contracting a licence for access to the visualisation of the training content, the user is authorised to visualise this content on a personal and non-transferable basis. This licence is granted on a non-exclusive basis and is limited to the duration of 12 months, exclusively in the form necessary to access the training platform.

The user acknowledges that he/she does not acquire ownership of the materials or the rights of distribution, downloading or storage. The licence only grants the right to access the NeoRejuvenation platform for the duration of its validity.

Any exploitation, downloading, dissemination, distribution or reproduction of the contents is prohibited without the express permission of Taking Back My Power Limited and Antonio Moll . Printing of the PDF materials is permitted for home and personal use only and distribution in any format is prohibited.

Illegal Use of Content

NeoRejuvenation LLC, Antonio Moll, Taking Back My Power Limited, their employees, agents and representatives shall not be liable for any damages, injuries or claims arising from the use of the training content obtained through unauthorised or unlawful websites.

Access to NeoRejuvenation content must be exclusively through our official platforms. Taking Back My Power Limited and NeoRejuvenation LLC do not guarantee the accuracy, integrity or security of content distributed illegally by third parties . Any exercises, techniques or information obtained outside of our official platforms are not covered by our usage policies or liability.

Users accessing the training illegally will be liable for any damage caused by the incorrect use of the exercises and any other negative consequences that may arise. NeoRejuvenation LLC and Taking Back My Power Limited reserve the right to take legal action against any individual or entity that distributes, accesses or uses our content without proper authorisation.

Your rights

Once you have paid to register for the NeoRejuvenation Online Training, you are entitled to receive, on the dates set out on the website(www.neorejuvenation.com, www.neorejuvenation2.com, antoniomoll.com) and its associated subdomains, the information necessary to access the training platform (username and password) at www.neorejuvena.com, www.neorejuvena.it, www.neorejuvena.org, www.neorejuvena.net, www.neorejuvena.tv, www.neorejuvena.me, depending on the language in which you wish to receive the training .

Your training access licence is personal and non-transferable, with a maximum duration of 12 months from the date of payment. After this period, the licence will be revoked and you will no longer be able to access the training content.

Privacy and Data Protection

NeoRejuvenation LLC, in partnership with Taking Back My Power Limited, is committed to protecting the privacy of personal data provided by users. Any personal information collected will be used exclusively to provide the contracted services and will not be shared with third parties without the explicit consent of the user, except where required by law.

NeoRejuvenation LLC implements appropriate security measures to protect personal data against unauthorised access. However, NeoRejuvenation LLC shall not be liable for security breaches beyond its reasonable control . Users are responsible for maintaining the confidentiality of their access credentials.

Newsletter Subscription Management

Users may unsubscribe from the newsletter at any time by clicking on the unsubscribe link included in each email or text message. By unsubscribing, the user agrees not to receive future communications related to the contracted services. NeoRejuvenation LLC and Taking Back My Power Limited shall not be liable for any lack of communication or information resulting from the user’s unsubscription from the newsletter, and the user shall not be entitled to claim refunds for the lack of such information.

Your Obligations

You agree and accept:

(a) to pay promptly for the contracted Service(s), (b) to comply with applicable laws, including but not limited to intellectual and industrial property laws, and you fully agree not to infringe the rights of third parties. In particular, (c) you will not engage in any activity that hinders or interferes with the operation of the Service, including the servers and networks that are connected to the Service, and (d) you may not use content accessed through the Service for educational or training purposes for third parties, i.e. you may not train others using NeoRejuvenation or Taking Back My Power materials and content.

Unless you have specific written permission under a separate agreement signed with the Provider, you also agree not to reproduce, duplicate, distribute, communicate publicly (by any means) or with any third party, copy, broadcast, host, share, store, sell, trade, market, resell, distribute, transform or modify the content / service; whether for profit or not.

Taking Back My Power Limited is the only entity authorised to handle any claims relating to the exploitation of the content, copyright or licensing.

You agree to be solely responsible, without liability to you or any third party, for any breach of your obligations under the Terms of Use and Agreement and for the consequences of any such breach, including any loss or damage that may be incurred by the Provider / Trainer / Taking Back My Power.

You agree to indemnify and hold harmless Antonio Moll, NeoRejuvenation LLC, Taking Back My Power Limited, their employees, agents and representatives, from any claims, losses, liabilities, moral, punitive damages and/or expenses, including reasonable attorneys’ fees, arising out of or related to your use of the service, your violation of these terms and conditions, or your infringement of any third party rights. This indemnification obligation shall survive the termination or expiration of these terms and conditions and your use of the service.

You also warrant that you have the necessary means and sufficient computer skills to be able to access and view the training. In particular, you will need a smartphone, tablet or computer with an Internet connection and the ability to view videos with sound. You will also need a valid email address that you can check frequently. In addition, you must have installed on your device (smartphone, tablet or computer), a programme that allows viewing documents in PDF format and a web browser duly updated to the latest version available (preferably Chrome).

Acceptable Use of the Service:

The user agrees to use the services of NeoRejuvenation LLC and Taking Back My Power Limited in a lawful and proper manner . Use of the service for activities that are unlawful, fraudulent, defamatory, harassing or infringing of third party rights is prohibited. NeoRejuvenation LLC and Taking Back My Power Limited reserve the right to suspend or terminate your access to the service in the event of any misuse of the service.

Defamation Protection Rights:

No Waiver:

The failure of NeoRejuvenation LLC and/or Taking Back My Power Limited to exercise or enforce any right or provision of these terms and conditions shall not constitute a waiver of such right or provision.
